Insurance/Recovery Tip:

One Year Deadline Clarified

There are 3 deadlines to file a lawsuit regarding a claim against your insurer:

  • Contract—the insurance policy itself—one year from the date of the loss.
  • Statute—California Insurance Code Section 2071 (and 2070)—one year from the date the claim is fully paid or closed or letter from insurer saying it is closed.
  • Case law—Prudential-LMI v Superior Court (delayed discovery rule)—one year from discovery of the loss.

None of the deadlines are contingent on any other activity, criminal or civil.

To avoid any unexpected complications, expense or dismissal, it is always safest and best to rely on the shortest deadline. One year from the exact day of the loss is the latest to timely file a lawsuit without incurring arguments from the insurance defense attorneys that the case be dismissed for an untimely filing.

In summary, the one year anniversary of the fires is approaching.  Alleged criminal activity by a third party will not extend any of these deadlines.

PLACERVILLE — A former American Red Cross manager was sentenced Wednesday for stealing thousands of dollars meant for victims of Lake Tahoe's Angora Fire.

Insurers are cutting back coverage, but at the same time raising deductibles and premiums, according to Consumer Reports, who says many companies are even checking your credit record to decide what they'll charge you.

Postfire Debris-Flow Hazards for the 2009 Station Fire, San Gabriel Mountains, Southern California

This report presents an emergency assessment of potential debris-flow hazards from basins burned by the 2009 Station fire in Los Angeles County, southern California. Statistical-empirical models developed for postfire debris flows are used to estimate the probability and volume of debris-flow production from 678 drainage basins within the burned area and to generate maps of areas that may be inundated along the San Gabriel mountain front by the estimated volume of material. Debris-flow probabilities and volumes are estimated as combined functions of different measures of basin burned extent, gradient, and material properties in response to both a 3-hour-duration, 1-year-recurrence thunderstorm and to a 12-hour-duration, 2-year recurrence storm. Debris-flow inundation areas are mapped for scenarios where all sediment-retention basins are empty and where the basins are all completely full. This assessment provides critical information for issuing warnings, locating and designing mitigation measures, and planning evacuation timing and routes within the first two winters following the fire.

A Times investigation has found that fire officials battling the Station fire reduced resources on the second day of what would become the largest brush fire in L.A. County history.
